Curbside Reviews – Will This Pose A Risk To Drivers Or Riders?

As mentioned in Commissioner Swart’s memo dated 3/2/07 to 19A Carriers and Certified Examiners, DMV wanted to notify the industry of the potential for a curbside verification. Here are a few FAQs that should help to further explain what to expect:

1) How will we know the person is an MVLE?

The MVLE will be in uniform (displaying DMV Key Logo) and will have official DMV Photo ID to present to the driver when they board the bus.

Should a carrier undergo a curbside verification, this is what will typically occur:

1) at a point of passenger pickup or drop off (although normally when bus/vehicle empty)

2) with an MVLE in uniform (same as at the road test sites…blue, black, white or white with pinstripe clothing consisting of uniform shirts, raincoats, winter coats, or windbreakers) with the key logo visible.

3) the MVLE will board the vehicle, showing identification (this would be a photo ID indicating that the MVLE is an employee of the NYS Department of Motor Vehicles) and will identify them as a Motor Vehicle License Examiner (or a Senior, or a Principal)

4) the MVLE will typically be accompanied by Senior or Principle MVLEs, perhaps a member of DPR staff, and most likely another DMV associate who has Peace Officer status (ability to ticket and arrest) in the event the driver needs to be detained.

5) in some cases, the DMV staff may do curbside verifications in conjunction with other state agencies such as the Department of Transportation, the State Education Department or the Office of Medicaid Inspector General.

2) Will DMV detain the driver?

In most instances, we will ask to see the driver’s license, which we will use to check license status, record key information onto a worksheet and the driver will be on their way. Our pilot testing has indicated that the MVLE will be on board each bus for about 1 minute. In the event it is found that the driver is not properly licensed for the class of vehicle, does not have a current and valid license, has any outstanding arrest warrants or is visibly intoxicated, we may need to detain the driver. In these instances, we would involve local law enforcement and also notify the carrier contact on our records that we have detained the driver.

3) Can DMV provide any advance notice to the carrier?

The purpose of curbside verifications is to give the department the ability to identify unreported drivers. Providing notice, even same day, would defeat the purpose of performing a curbside. We do plan to notify local law enforcement in advance of performing curbside verifications so as to minimize any potential concerns.
